Waste Legislation

It can be a minefield for businesses to comprehend the existing legislation surrounding waste and keep abreast of new regulations and guidance being introduced, which in recent years has been at a phenomenal pace.

Duty of Care – Your waste responsibilities

This guidance is for businesses that import, produce, store, treat or dispose of waste. IWMS work with businesses to ensure that all of their ‘duty of care’ requirements are fulfilled. We only work with contractors who are legally authorised to transport and dispose of waste and ensure that all appropriate documentation is completed to guarantee full compliance with this legal requirement.

Hazardous/Special Waste

Some wastes, such as fluorescent light tubes, are classed as hazardous waste (or special waste in Scotland). These wastes need to be disposed of with specific paperwork called consignment notes and within many companies, there is a need to register as a hazardous waste producer. IWMS can assess business requirements to register with the environmental regulator and guide them through this process to ensure wastes are recorded and disposed of in the correct manner.

Waste Electrical & Electronic Equipment (WEEE)

Electrical and electronic waste is the fastest growing waste stream in the UK. Around 1.8 million tonnes is generated every year. IWMS are helping companies to find appropriate disposal routes for their electrical wastes and ensure they are complying with diverting these wastes from landfill.

Landfill Directive (Pre-treatment regulations)

The most recent introduction from the Landfill Directive is the Pretreatment regulations, which came into force on 31 October 2007. This has had a large impact on all businesses that are now required to treat their waste before sending to Landfill. IWMS have been working with all our clients to ensure they strategically look at their waste and consider different options of treatment, including recycling.

Packaging Regulations

The Packaging (Essential Requirements) Regulations apply to you if your business produces packaged products, or places packaging or packaged goods on the market.

The Producer Responsibility Obligations (Packaging Waste) Regulations apply to you if your business handles more than 50 tonnes of packaging in a year and has a turnover of more than £2 million.
